Regulatory and public affairs
A regulator reads a client’s press statements, its consultation responses and its letters as one body of evidence. We help clients write all three as if they will be read together, because they will be.
Our regulatory work covers the whole life of a client’s relationship with the bodies that license, inspect or investigate it: consultation responses, inquiries and select committees, enforcement proceedings, licensing decisions and appeals, and the years of compliance reporting that usually follow.
Increasingly that includes the regulators that license autonomous systems. For an operator, a licensing decision is published at a time of the regulator’s choosing and in the regulator’s words. What the operator says next, to its customers, its staff and the regulator itself, is the part it controls, and it is read closely by people who will decide its next application.
We do not lobby for outcomes in individual cases, and we do not contact regulators on a client’s behalf without the client’s lawyers knowing. We help clients make their own case clearly, consistently and in a register a regulator will respect.
What it involves
- Consultation responses, evidence to inquiries and select committee preparation
- Communications around investigations, enforcement decisions and licensing decisions
- Appeals: what to say while a decision stands and the appeal is heard
- Correspondence strategy with regulators, written with the client’s counsel
- Stakeholder mapping in Westminster, Whitehall, Washington and the relevant regulators
- Recall and field safety communications for regulated products
In practice Catherine Dunmore has prepared more than forty witnesses for select committees and public inquiries. Nathaniel Cobb spent six years writing enforcement announcements for a federal regulator before he began advising the people on the other side of them.
